Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the VisiTime mobile application or website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a binding legal agreement between you and VisiTime (“we,” “us,” or “our”).

We may update these Terms from time to time. Your continued use of the Service after any update constitutes your acceptance of the revised Terms. The current version is always available at visitime.net/terms.

2. Eligibility

You must be at least 16 years of age to use the Service. By using VisiTime, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

VisiTime is not directed at children under 16. If we become aware that a user under 16 has registered, we will remove that account and associated data.

3. Accounts and Security

3.1 Registration

  • You may register using a phone number with one-time password (OTP), Google Sign-In, or Apple Sign-In
  • You agree to provide accurate and current information when creating your account
  • You are responsible for maintaining the confidentiality of your account credentials

3.2 Account Responsibility

  • You are solely responsible for all activity that occurs under your account
  • You must notify us immediately at [email protected] if you suspect unauthorized access
  • We are not liable for losses arising from unauthorized use of your account

3.3 One Account per Person

  • Each person may maintain one personal client account; business owners may additionally register a separate business account
  • We reserve the right to merge or terminate duplicate accounts

4. The Service

4.1 Marketplace Nature

VisiTime is a marketplace platform that connects clients seeking appointment-based services with independent businesses and service providers (“Businesses”). VisiTime facilitates discovery, booking, and communication between clients and Businesses; it does not itself provide grooming, beauty, fitness, medical, wellness, or any other professional service.

4.2 No Party to Service Agreements

When you make a booking through VisiTime, you enter into a direct agreement with the Business. VisiTime is not a party to that agreement and is not responsible for the quality, safety, legality, or any other aspect of the services provided by the Business. Any disputes regarding the services must be resolved directly with the Business.

4.3 Independent Businesses

  • Businesses on VisiTime are independent third parties, not employees or agents of VisiTime
  • VisiTime does not supervise, direct, or control the services performed by Businesses
  • VisiTime makes no representations or warranties regarding the quality or fitness of any Business's services

5. Bookings, Reminders, Cancellations, and No-Shows

5.1 Making a Booking

  • A booking confirmed through VisiTime constitutes an agreement between you and the Business
  • Booking reminders sent by VisiTime are a courtesy feature; we do not guarantee delivery and are not liable for missed appointments due to notification failures
  • It is your responsibility to arrive at the appointed time and place

5.2 Cancellations

  • Cancellation policies are set by each Business and displayed at the time of booking
  • VisiTime is not responsible for cancellation fees or penalties imposed by Businesses
  • You should review each Business's cancellation policy before confirming a booking

5.3 No-Shows

  • Policies regarding no-shows are determined by the individual Business
  • Repeated no-shows may result in your account being flagged or access to certain Businesses being restricted

5.4 Business Modifications

  • Businesses may modify or cancel bookings in accordance with their own policies
  • VisiTime will endeavor to notify you of such changes via push notification or in-app message, but makes no guarantee of notification delivery

6. Payments

6.1 Client App — Free to Use

The VisiTime client app is free to download and use. VisiTime does not charge clients any booking or service fees through the client app. Any payment for services rendered is made directly to the Business in accordance with the Business's own payment terms.

6.2 Business Subscriptions

Businesses may access premium features of the VisiTime Business platform under a separate subscription plan. Business subscription billing, pricing, and terms are governed by the VisiTime Business Terms and the Business Privacy Policy. Client users are not subject to business subscription fees.

6.3 Third-Party Payments

  • Any payments processed in connection with the Service are handled by third-party processors (such as Stripe) under their own terms and conditions
  • VisiTime does not store full payment card details

7. User Conduct and Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Submit false, misleading, or fraudulent bookings or reviews
  • Harass, threaten, or abuse other users or Business staff
  • Impersonate any person, business, or entity
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Scrape, crawl, or systematically extract data from the Service without our written permission
  • Introduce viruses, malware, or other harmful code
  • Use the Service for any commercial purpose not expressly authorized by us
  • Circumvent any security, access control, or rate-limiting mechanism of the Service

We reserve the right to suspend or terminate accounts engaged in prohibited conduct without prior notice.

8. Reviews and User Content

8.1 Truthfulness

  • Reviews and ratings you submit must reflect your genuine, first-hand experience with the Business
  • Fake, incentivized, or malicious reviews are prohibited and will be removed
  • You must not submit reviews for businesses at which you have not received services

8.2 License to VisiTime

By submitting a review, rating, photo, or any other content (“User Content”), you grant VisiTime a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, distribute, and adapt such User Content in connection with the Service, including for promotional purposes.

8.3 Content Standards

  • User Content must not contain profanity, hate speech, discriminatory language, or personally identifiable information about third parties
  • We may remove User Content that violates these standards at our sole discretion, without notice
  • You retain ownership of your User Content subject to the license granted above

9. Business and Provider Responsibilities

Businesses that register on VisiTime agree to:

  • Provide accurate information about their services, pricing, availability, and location
  • Honor confirmed bookings in accordance with their stated policies
  • Comply with all applicable laws, including professional licensing, health and safety, and consumer protection regulations
  • Handle client personal data received through VisiTime in accordance with applicable data protection law and the VisiTime Business Privacy Policy
  • Resolve disputes with clients directly and in good faith

VisiTime is not responsible for a Business's failure to meet these obligations. Clients should contact [email protected] to report serious concerns.

10. Intellectual Property

10.1 VisiTime Content

All content, software, design, trademarks, logos, and other materials that are part of the Service (“VisiTime Content”) are owned by or licensed to VisiTime and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from VisiTime Content without our prior written consent.

10.2 Your Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

10.3 Feedback

If you provide us with suggestions, ideas, or feedback about the Service, you grant us a perpetual, royalty-free license to use that feedback without restriction or compensation to you.

11. Third-Party Services

The Service integrates with or links to third-party services, including:

  • Apple App Store / Apple Sign-In — subject to Apple's terms and privacy policy
  • Google Play / Google Sign-In — subject to Google's terms and privacy policy
  • Google Maps and Google Places — map display and location search, subject to Google's terms
  • Firebase (Google) — push notifications, analytics, and crash reporting
  • Twilio — SMS delivery for one-time passwords
  • Stripe — payment processing for Business subscriptions

VisiTime is not responsible for the content, practices, or terms of any third-party service. Your use of third-party services is at your own risk and governed by their respective terms.

12. Disclaimers

Please read carefully

The Service is provided “as is” and “as available” without warranty of any kind. To the maximum extent permitted by applicable law, VisiTime expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Service or obtained through the Service.

VisiTime does not endorse any Business or service provider listed on the platform and makes no warranty regarding the quality, safety, or legality of services offered by Businesses.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will VisiTime, its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising from or related to your use of or inability to use the Service, even if VisiTime has been advised of the possibility of such damages.

To the extent that VisiTime's liability cannot be excluded under applicable law, our aggregate liability to you for all claims arising from or relating to the Service shall not exceed the greater of: (a) the amounts you paid to VisiTime in the twelve months preceding the claim, or (b) one hundred euros (€100).

14. Indemnification

You agree to indemnify, defend, and hold harmless VisiTime and its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any law or the rights of a third party.

15. Suspension and Termination

15.1 By VisiTime

  • We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to users, Businesses, or the Service
  • We may also discontinue the Service or any part of it at any time

15.2 By You

  • You may delete your account at any time through the app settings or by contacting [email protected]
  • Termination does not affect any rights or obligations that arose before termination

15.3 Effect of Termination

  • Upon termination, your right to use the Service ceases immediately
  • Sections that by their nature should survive termination will do so, including Sections 8.2, 10, 12, 13, 14, and 17

16. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes by updating the “Last Updated” date and, where appropriate, by in-app notification. Your continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict-of-law provisions. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Poland.

If you are a consumer resident in the European Union, you may also have the right to submit a complaint to the relevant consumer protection authority in your country of residence and to access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
