VisiTime Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the VisiTime mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a binding legal agreement between you and VisiTime ("we," "us," or "our").

We may update these Terms from time to time. Your continued use of the Service after any update constitutes your acceptance of the revised Terms. The current version is always available at visitime.net/terms.

2. Eligibility

You must be at least 16 years of age to use the Service. By using VisiTime, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

VisiTime is not directed at children under 16. If we become aware that a user under 16 has registered, we will remove that account and associated data.

4. The Service

4.1 Marketplace Nature

VisiTime is a marketplace platform that connects clients seeking appointment-based services with independent businesses and service providers ("Businesses"). VisiTime facilitates discovery, booking, and communication between clients and Businesses; it does not itself provide grooming, beauty, fitness, medical, wellness, or any other professional service.

4.2 No Party to Service Agreements

When you make a booking through VisiTime, you enter into a direct agreement with the Business. VisiTime is not a party to that agreement and is not responsible for the quality, safety, legality, or any other aspect of the services provided by the Business. Any disputes regarding the services must be resolved directly with the Business.

6. Payments

6.1 Client App — Free to Use

The VisiTime client app is free to download and use. VisiTime does not charge clients any booking or service fees through the client app. Any payment for services rendered is made directly to the Business in accordance with the Business's own payment terms.

6.2 Business Subscriptions

Businesses may access premium features of the VisiTime Business platform under a separate subscription plan. Business subscription billing, pricing, and terms are governed by the VisiTime Business Terms and the Business Privacy Policy. Client users are not subject to business subscription fees.

8. Reviews and User Content

By submitting a review, rating, photo, or any other content ("User Content"), you grant VisiTime a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, distribute, and adapt such User Content in connection with the Service, including for promotional purposes.

10. Intellectual Property

10.1 VisiTime Content

All content, software, design, trademarks, logos, and other materials that are part of the Service ("VisiTime Content") are owned by or licensed to VisiTime and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from VisiTime Content without our prior written consent.

10.2 Your Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

10.3 Feedback

If you provide us with suggestions, ideas, or feedback about the Service, you grant us a perpetual, royalty-free license to use that feedback without restriction or compensation to you.

The Service integrates with or links to third-party services, including:

VisiTime is not responsible for the content, practices, or terms of any third-party service. Your use of third-party services is at your own risk and governed by their respective terms.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VISITIME EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE SERVICE OR OBTAINED THROUGH THE SERVICE.

VISITIME DOES NOT ENDORSE ANY BUSINESS OR SERVICE PROVIDER LISTED ON THE PLATFORM AND MAKES NO WARRANTY REGARDING THE QUALITY, SAFETY, OR LEGALITY OF SERVICES OFFERED BY BUSINESSES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VISITIME, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF VISITIME HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT THAT VISITIME'S LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO VISITIME IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).

14. Indemnification

You agree to indemnify, defend, and hold harmless VisiTime and its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any law or the rights of a third party.

16. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, where appropriate, by in-app notification. Your continued use of the Service after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict-of-law provisions. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Poland.

If you are a consumer resident in the European Union, you may also have the right to submit a complaint to the relevant consumer protection authority in your country of residence and to access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
